AI Tools, Inc. DBA Spawn ("Spawn," or "we," or "us," or "our") is committed to safeguarding your privacy. This Privacy Policy ("Privacy Policy" or "Policy) describes our policies and procedures regarding the collection, use and disclosure of certain information, including your personal information, based on your interactions with us online, including on our website, websites and/or applications created by Direct Users and hosted by Spawn ("Spawn Sites"), and any other online or mobile services we may provide (collectively, the "Spawn Service"). By using the Spawn Service and otherwise interacting with us, you agree to the terms of our Terms of Service and this Privacy Policy.
As used in this Privacy Policy, a "Direct User" is an individual or business entity who has an account with Spawn and can build or create a Spawn Site, and an "End User" is an individual or business entity who visits a Spawn Site or our website but is not a registered Direct User.
1. Personal Information We Collect
We collect personal information from you when you interact with the Spawn Service, especially when you visit or use the Spawn Service, create a website or application on the Spawn Service, request information from us, register or create an account with us, interact with a Spawn Site, register for our newsletter or subscribe for product updates, place inquiries, comments, feedback or complaints, contact us via email or by phone, or otherwise interact with us through the Spawn Service. We also collect personal information from third parties if you choose to log into the Spawn Service with your third-party credentials, such as your Google log-in credentials, profile picture and display name.
We collect the following categories of personal information:
From Direct Users
- Personal identifiers: name, email address, mailing or billing address, phone number, IP address, account usernames and passwords, social media handles, and any personal information contained in customer reviews, inquiries and complaints
- Commercial and financial information: credit card or other payment information via our third-party payment processors; records of products or services ordered or considered
- Internet or other electronic activity information: your IP address, your device and browser type, your browsing and search history on the Spawn Service, and information regarding your interactions with the Spawn Service and our advertisements
- Geolocation information: information regarding your location if you choose to provide it in your Spawn account profile
- Audio and visual information: your profile picture (or your profile picture displayed in your Google account if you choose to connect your Google account with your Spawn account) if you choose to upload one in your Spawn account profile
Upon the creation of your application(s), we will offer Direct Users an option for us to send a notification via text messaging to confirm when the creation has been completed. To receive these notifications, you must provide your telephone number, which constitutes your explicit consent to receive SMS notifications from Spawn. By entering your phone number, you acknowledge that message frequency varies, standard message and data rates may apply, and that you can reply STOP to unsubscribe at any time. You may stop receiving these notifications at any time by following the opt-out instructions provided in the text messages. We will not share your telephone number with any third party, for any reason.
From End-Users Who Access Spawn Sites or Visit Our Website
While we do not collect personal information directly from End-Users in most cases, we collect, receive or store personal information about End-Users who access Spawn Sites created by our Direct Users on behalf of our Direct Users or when you visit our website. Direct Users may require certain personal information to be collected from End-Users on Spawn Sites. Thus, we collect the following categories of personal information:
- Personal identifiers: name, email address, mailing or billing address, phone number, IP address, account usernames and passwords, social media handles, and any personal information contained in customer reviews, inquiries and complaints

- Audio and visual information: your profile picture (or your profile picture displayed in your Google account if you choose to connect your Google account on the Spawn Site) if you choose to upload one
2. How We Use Your Personal Information
We use the personal information we obtain or receive through the Spawn Service to provide you with the information you request and services that you request, order or that are ordered on your behalf, facilitate and manage the creation and security of your Spawn account and account profile, identify you as a user of the Spawn Service, contact you from time to time, process your payments, provide you with customer support, required notices, advertisements, marketing promotions and offers about products or services we think may be of interest to you, including our own products and services.
We also use your personal information about your use of the Spawn Service to monitor and improve the Spawn Service; for internal business analysis and analytics; to prevent fraud, activities that violate our Terms of Service or that are illegal; to comply with our legal obligations and to protect our rights and the rights and safety of our users or others.
3. Disclosure of Your Personal Information
We disclose your personal information with service providers that help us operate our business, including through payment processing, verifying customer information, managing customer information, providing customer service or technical support, facilitating email communications, providing security services and cloud-based data storage, hosting the Spawn Service and assistance with other IT-related functions, conducting and providing data analysis and business analytics, advertising and marketing of our products, and providing legal and accounting services.
We also disclose your personal information as required or permitted by law to comply with a subpoena or similar legal process or government request or inquiry, or when we believe in good faith that disclosure is legally required or otherwise necessary to protect our or others' rights, property, or safety, including to law enforcement agencies and judicial and regulatory authorities. We may disclose your personal information to third parties to help detect and protect against fraud or data security vulnerabilities. And, we may transfer your personal information to a third party in the event of an actual or proposed sale, merger, or reorganization of our entity or other corporate restructuring.
We do not share end-user information with third parties or affiliates for marketing or promotional purposes. Your personal information is only shared with our subcontractors or outsourced service providers solely to fulfill the services we provide to you.
4. Cookies and Analytics
We may use cookies, pixel tags, web beacons and other similar tracking technologies ("tracking technologies") to automatically collect information through the Spawn Service. Tracking technologies are small data files placed on your computer, tablet, mobile phone, or other devices that record certain pieces of information when you visit or interact with the Spawn Service, including our website and Spawn Sites. We may use these tracking technologies to provide business analytics on our website and Spawn Sites, monitor and improve the Spawn Service, help identify irregular behavior, prevent fraudulent activity and improve security, as well as making it possible for you to save your preferences and help us understand how you interact with the Spawn Service.
Third parties may also use some of these technologies to assist us in determining if you require assistance or are having problems navigating on the Spawn Service, and this may include technologies that record your interactions with the Spawn Service, including without limitation, your keystrokes, mouse clicks, screen touches, and information about when, how and from where you accessed the Spawn Service.
We do not use tracking technologies or otherwise collect personal information about your online activities over time and across different websites when you visit or interact with the Spawn Service.
You may set your browser to notify you when you receive a cookie. Many web browsers also allow you to block cookies. You can disable cookies from your computer system by following the instructions on your browser or at www.youradchoices.com.
5. Retention of Your Personal Information
We will retain your personal information only for the length of time necessary to fulfill the purposes outlined in our Privacy Policy unless a longer retention period is required or permitted by law.
6. Do Not Track Signals
Do Not Track ("DNT") header signals allow users to tell certain websites not to track their online activities. Because there is no current industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.
7. California Shine the Light Law
California Civil Code Section 1798.83, also known as the "Shine the Light" law, permits California residents that have an established business relationship with a business to annually request, free of charge, information about certain categories of personal information a business has disclosed to third parties for those parties' direct marketing purposes in the preceding calendar year. We do not disclose personal information to third parties for their direct marketing purposes.
8. Personal Information of Minors
The Spawn Service is not directed or targeted to minors under the age of 13, and we do not knowingly collect, maintain or use any personal information of minors. If we learn that we have collected any personal information about minors under 13, we will delete such information as soon as reasonably practicable.
9. How We Keep Your Personal Information Secure
We implement and maintain reasonable security measures appropriate to the nature of the personal information that we collect, use, retain, transfer or otherwise process. Those security measures include administrative, physical, and technical safeguards designed to protect the security, confidentiality, and integrity of your personal information. While we strive to secure your data, no system can be entirely secure as data security incidents and breaches can occur due to a variety of factors that cannot reasonably be prevented; therefore, our safeguards may not always be adequate to prevent all breaches of security and it cannot be assumed that the occurrence of any given incident or breach results from our failure to implement and maintain reasonable security.
10. Other Third-Party Websites and Social Media Buttons
The Spawn Service may contain links to other third-party websites, including social media buttons that link to social media platforms. We are not responsible for the privacy practices or the content of those websites or social media platforms. The privacy policies and terms of use for those third parties' websites or social media platforms govern those third parties' privacy practices. This Privacy Policy applies only to our business and the personal information we collect.
11. Changes to This Policy
We may update this Privacy Policy from time to time, especially to reflect changes in applicable laws. If we make changes to this Privacy Policy, we will post those changes on our website and update the date of the Privacy Policy. If the changes are material, you will be notified via a notice on our website.
